Help Needed. Putting a charge on a property.

Thanks for looking.

I wondered if there was anyone on here that has knowledge of getting a charging order put on a property.

I do not wish to use the services of a solicitor for this as I am informed that it is easy enough to do myself but I went to court for this last week and was humiliated to have it adjourned for 28 days as I didn't bring a form that listed the people that I had served with the interim charging order as I hadn't been told that this was necessary.

The Judge was a little 'short' with me and I couldn't ask her what other forms Etc I needed so I thought that, before I make a complete idiot of myself, I'd ask on here if anyone could give me the info that I need.

What is the Judge going to need in order to make the interim charge permanent?

I have searched the 'net' to no avail and even the HMSO forms and leaflets don't seem to make it clear.

Any advice would, be more than welcome. (except, employ a solicitor)

    I don't know if you have seen this http://www.hmcourts-service.gov.uk/courtfinder/forms/ex325_0405.pdf but it tells you what to do. The form is also available on the Court Service website http://www.hmcourts-service.gov.uk/HMCSCourtFinder/GetForms.do;jsessionid=72CF86470BB5F15F61A1FF1CB8943860.

    Once you have the charging order the form you need for registering it with the Land Registry is this one I think http://www.landregistry.gov.uk/assets/library/documents/k4.pdf but you will find the Land Registry staff helpful and they will tell you for sure if you ring one of their offices http://www.landreg.gov.uk/regional/offices/

    It really should be simple enough to do yourself, rather than go to the expense of using a solicitor.

    Unfortunately, a lot of county court judges do get snooty with litigants in person but you do also get those who will do all they can to assist and direct you to the court desk where staff should have given you the leaflet and form I have linked to above.

    A charging order is put on a property when someone has defaulted on payments ordered by a court. You cannot put it on until they default and they have the opportunity to object before it is done. This then prevents the house from being sold without notice to the person holding the charging order and the debt would have to be satisfied from the proceeds of sale on completion if a sale was allowed to go ahead. There are also circumstances in which the person holding the charging order can request that the property be sold to pay off the debt.
