Tesco Digital not honouring Tesco Entertainment Music Downloads

  • I'm another Tesco victim. I contacted Tesco and asked to have my licenses restored. They said they couldn't as described above. I next asked to have all the money I'd spend on downloads refunded (I'd kept all the receipts). They of course refused and quoted the small print at me from the original site:

    "We reserve the right to modify, suspend or discontinue this Service (or any part of it) without notice to you and shall not be liable to you if we exercise these rights. You acknowledge that you may no longer be able to replace the Downloads if we discontinue the Service and you agree that we shall have no liability to you in that event."

    So that's pretty clear. Question is 'is it legal?'. I got on to Consumer Direct (http://www.consumerdirect.gov.uk/ or phone 08454 04 05 06) who said this would fall under the Unfair Contract Terms Act (1977). They're assigning someone to look into this so that's encouraging although I'm sure Tesco's lawyers have advised that they can get away with this.

    Still, if you feel strongly about this and don't want to go down without at least putting up a fight you might also try contacting Consumer Direct.

    I am sorry that you are unhappy we have closed down Tesco Music Downloads.

    Tesco Music Downloads no longer exists, as we are no longer offering any customer support for this site. The media supplier for Tesco Digital will not honour any downloads bought through our old suppliers.

    Under section 8, paragraph 3 of the terms and conditions of our old site, it clearly states the following:

    "We reserve the right to modify, suspend or discontinue this Service (or any part of it) without notice to you and shall not be liable to you if we exercise these rights. You acknowledge that you may no longer be able to replace the Downloads if we discontinue the Service and you agree that we shall have no liability to you in that event."

    These are the terms and conditions you agreed to when registering with the old downloads site.

    We are sorry of you feel unhappy that you can no longer access our old site, and offer apologies for any disappointment caused.

    Of course I seem to have missed this bit of small print when I signed up. I also can't verify this due to the old site no longer existing so who knows!! Will now be checking any future download sites for this particular piece of info before I sign up..:mad:

    This used to happen quite a bit IIRC when lots of start up sites got taken over by the bigger boys. Remember I lost quite a bit. Bleeding annoying.
  • As I previously mentioned I reported this to Consumer Direct who agreed to look into this. They've just got back to me with the following:

    "Tesco have said that they made a mistake and you should have been credited with the amount you had paid for the lost downloads. I understand that Tesco will be contacting you directly to apologise and refund you."

    I haven't heard from Tesco yet but this looks encouraging.

    I don't think i will risk chancing the new Tesco Download site, I think its scandalous.
