Problems with Barclaycard. Any ideas? Im lost!

    If the account is purchased by a DCA then the OC have washed there hands of it. However if they are charged with collecting for a OC it is a different situation . I,m sure that in an effort to get as much as they can from you , they offer a settlement figure . This figure will satisfy the DCA because they take their chunk out and send rest to OC . Result the OC still want the remaining amount ! This is why everyone dealing with a DCA must get proof of assignment before dealing with them ! I did try POSTING a list of DO AND DON,T DO,S WHEN DEALING WITH A DCA. . But got criticised so discontinued it .

    In most cases full and final sent out in writing work fine. Reclaiming bank charges after a full and final is a different matter, if you saved more than you would get back reclaiming then you've lost nothing.

    Can anyone advise on what legislation would cover this?

    A F&F offer is made and accepted
    Unlawful charges are reclaimed
    Money is then put towards the account that is already settled?

    Just wondering as i haven't come across this before.

    There is a way to get these charges back to you.

    The charges were paid to the OC by way of payment allocation. The charges do not constitute part of the outstanding debt which incidentally the OC no longer owns so therefore cannot be towards outstanding debt via offsetting debt as you no longer have a debt to that company.
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

    Just to let you know that Mercers is part of Barclays - they are their own debt collection department, so the debt was not sold to them, they are a trading division of Barclays.
    I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!

    I had no idea Mercers were part of Barclaycard thankyou very much for pointing that out. Hubby called bc last night and they told him the account was settled and closed. When he asked for the charges money to be sent via cheque they told him they were unable to do that. Why? No one knows! He was cut off twice and three other people told him to just drop the claim. We are wondering whether to send the next letter (threatening court action) or just skipping that and going straight to the FO.

    However we have made slight progress in that bc are now admitting the account is closed and there is no money owing on it.
