Problems with Barclaycard. Any ideas? Im lost!

My husband had a credit card with Barclaycard and the debt was sold to Mercers dca. He telephoned Mercers and asked for a settlement figure which they told him was £775 (debt was £963 i think). He is trying to reclaim the charges back and barclaycard said they would offer him £104 plus interest (claim was £300+) and take it off what he owes them. DH explained that he had settled the account but barclaycard said there is still an amount outstanding.

Mercers have confirmed that the account is settled and closed yet today Barclaycard have sent him a statement and they have indeed refunded the £104 plus interest and asked for payment of the remainding £88 something to settle the full £963 (ish) balance of the cc! What do we do here? We thought that by agreeing a full and final settlement figure with Mercers, the account was settled!

Any ideas?

    Well another example of why you should not deal on the phone with these companies. Agreements on the phone are not worth paper they are written on! Shame you had not asked for advice before You have been turned over am afraid .

    We have it in writing from Mercers that the account has been settled and is now closed. Barclaycard are refusing to accept it.

    Talk to CCCS or debt free direct. They will know where you stand in relation to the law. Sorry can't be more helpful.

    thankyou tigger. hubby is in a dmp with cccs at the mo so i will ask him to call them and ask their advice.

    Hi Monica

    Something very smiliar has just happened to me with Barclaycard....

    I paid them in full and final settlement in November 2007, and had confirmation from the debt collection company it was all settled and the account was closed. My reports with the credit reference agencies was updated showing as satisfied, with a zero balance.

    I then, after discovering I had paid over £600 in charges over the years, decided to try and claim them back. The balance written off from the full and final settlement was £595. They wrote back saying they'd give me c.£300 and remove it off the balance owing. I called back and said the account is settled, you can't take it off the balance. They told me they could, so I dropped the matter - it was a shot in the dark anyway!

    Then a month later I check my credit report with Experian, and find out I have an outstanding balance of £595 with Barclaycard!

    I've written to them asking to correct the information, but am yet to hear back from them. I'm guessing that by trying to reclaim charges, they have reopened our accounts.... surely they can't do this?? Full and final settlement should mean exactly that!

    I'd be interested to see what advice you get from CCCS.

    rebecca im sorry you are having the same experience with them but glad that hubby isnt the only one having issues with them if you know what i mean. It seems they are being petty due to the charges reclaim but from what i have read they cant use the charges reclaim against you so surely if we complained to the FO something will be done?

    When hubby said he was going to the FO the bloke on the phone said he had never heard of a financial ombudsman (however his name was Gulab and he was based in India........)

    Looks like we've annoyed them trying to reclaim! I'm not bothered about not getting any money back (I didn't really expect to to be honest), but in theory 'cancelling' our full and final settlements because we tried to claim on a closed account is absolutely crazy!

    I wrote to them last week, giving them 7 days under the data protection act to update my records (they also re-registered a default that had previously been removed, as I had never received any paperwork and they had no record of it!).

    I'm checking my credit report every day or so in the hope they'll just correct it. I'll let you know if anything happens or if I hear back from from - otherwise the FO does seems the best route.
