Hello, I had a credit card about two years ago of which could have a second person on it. I got the card for him.me, wife and kids wanted to go to Disney usa.he got wind of this and wanted to take his wife and kid’s aswell.he started putting all his debts on the card. Two years later it was getting too much for me. Now the card had £12,000 on it. I had to put a stop to it and told him I was doing an Iva with Spectrum Financial. He got a bit upset and said well it’s your debt now not mine and will not pay back the money he put on the credit card. Why should I pay back his debts. I only had about £2500 on the card at the time. I asked bank of Scotland for his statements, but at £5 a time is a lot of money. I need them to sort this mess out. Can any one help me with this.

    We all do crazy things at times and I guess you learn from your mistakes. If you want to get hold of your statements if you write to them and enclose £10 under the data protection act you can get the last 6 years worth. There is a link on here to the letters somewhere which I will try and find (unless someone else can help quicker!)
    I do think however being able to prove that he has spent it could be difficult.

    It's the person who's name/signature is on the account (credit agreement) who is legally liable for the debt.

    If you allow a card on your account to be issued in someone else's name, you are still liable for any spending on it.

    NB. Credit cards are not taken in joint names, if you have two cards, then only one cardholder is considered the account holder. They will be responsible for full repayment for the debt, regardless of which card was used.

    sorry, nothing you can do about him paying back anything - you are the main card holder and are responsible for paying back anything a second named holder spends.

    whoa here there is plenty you can do. You could sue him in the small claims court for starters.

    There doesn't need to be a written agreement just implied agreement that monies will be paid. Happy to help further if you want. You could also consider reporting the matter to the police for obtaining money by deception contrary to section 17 theft act 1968. Again happy to help further.

    If this guy has intimidated you out of money then either pay it or report it as a crime.
