Backdating Carer's allowance?

Hi, my mother applied for DLA, in December 2007, and was refused, I therefore duly completed the appeals form etc, and is due before tribunal this friday, 30 May. My father basically looks after all her needs, and should therefore apply for Carer's Allowance?, he is a pensioner also. What I would like to know is if she is awarded the DLA and it is backdated to December 2007, is it possible now for me to submit a claim for carer's allowance on behalf of my father, and will it be backdated also to December 2007? or even 3 months prior to December 2007? Any advice/clarification greatly appreciated...:o

My basic understanding is that as long as the new Carer's Allowance application is submitted within 3 months of the decision of the DLA, it will be backdated to the date of the DLA decision whatever that date is.
  • if your father receives state pension then he wont get carers as it whats known as an "overlapping"benefits.HOWEVER,it can still be worth claiming it as it might uner certain circumstances passport him to some other extra cash

If the claim is made within 3 months of the decision to award DLA (Including a decision made on appeal) the CA can be backdated to the same date that the DLA is backdated to.

The DLA must be awarded at either middle or higher rate care to qualify for the CA
