Can they claim?

Not sure if anyone cal help me? I used to have a car insured with a well known company. I had an accident and they paid for the damage. I had some cash issues and didn't have a bank account so was paying all my direct debits from my partners account with their permission. The company advised they could not accept payment from her account and would not take a card payment from my partner either on a monthly basis, they then said that as i could not set up a direct debit from my own account that they needed to take the payment in full. I advised i couldn't afford it all in one go so had to cancel the policy and take up insurance with another company. Now, two and a half years later I have been contacted by a debt agency advising that i owe the company over £600 as they state i never paid the insurance at all. I no longer bank with the bank i had the direct debit set up with originally so cannot find out how much was taken. is there anything i can do or are they entitled to claim the money?

  • They are fully entitled to a full years premium from you if you claimed, as well as any reasonable charges incurred in chasing the debt

    The fact that you are no longer with the same bank does not prevent you from obtaining statements from them, which can then be checked in order to determine whether the any premiums were paid.

    Of course they are entitled to claim any unpaid premiums. They settled a claim and thus the full annual premium becomes due, regardless of the fact that the policy was cancelled.
