Hi fellow BRs
Just finally got the balls to fill in the online BR forms,
What can i expect to happen now?? kaking my pants to tell the truth!!!
My current situation as at 26 MAY 08
Split from Wife last year, i got tto keep the house
My mortgage is still in joint names, im only £600 in arrears at the mo, but other creditors have suffered because of this
My DEBT LIST IS BELOW
HSBC 2k
EGG 1K
NORTHERN ROCK 38K
MBNA 6K
ABBEY 1K
and a few other creditors which add upto another 2K
My house has been on the market since we split, due to credit crunch, no sale yet
I have decided not to pay my mortgage this month and pay the fee for BR instead??, not to sure wether this is a wise move or not??
Court summons appeared as im behind on Council Tax,
Im at a total loss at the mo, you read other posts, yet the more you read, the more confused i get??
My plan is to move nearer work, nearer my kids, save on petrol, walk to work and rent a half decent place for my kids to stay
Thats another worry, can you rent when you are a BR??
Any one with any advice would be much appreciated
CCCS advised me to go BR 6 months ago, but just didnt want to lose my home, but now i cant wait to see the back of it

Hiya
Can't answer all your queries but can help with a couple. We stopped paying the mortgage and creditors to save the money to go BR. When we decided to do that, we called a few lettings agent in our area to ask if they were happy to rent to undischarged bankrupts. There were two out of the four we rang, and we saw one house and are just going through the process of getting references, etc. The lettings agent we used ask everyone for a guarantor and a certain amount of money up front.
I don't think you need to tell your LL that you are bankrupt unless there is a bankruptcy clause in your tenancy agreement, so check on that too. Most LLs are just happy to get their rent cheque every month!!

Hiya G&D firstly welcome to the forum.......
I can only echo what MG has said really you do need to contact one of the free debt helplines again for further advice (anyone in my sig below) my OR told our landlord about my Bankrputcy back in march last year...they replied "long as we get the rent each month we dont care" but make sure your tenancy agreement does not contain a bankruptcy clause...if it does then you could have problems if the OR contacts your LL

Thought no one was going to respond to my post, chewing my nails to the bone, got a question for you
Im going to court on Wed, I get paid wednesday also, what do i do, some posters say, take the money out, some say, close your account and open another one, and then some say you cant touch it???
Also, can i pay the fees on my debit card, as i cant draw out any more than £300 a day

You can pay the fees on your card...most OR's turn a blind eye to this....you "could" get the cash from your account before you attend court as once the BR order is signed your account and all your finances become the OR's property....if you wanted to wait until after the court case you would need to contact the OR office to release funds from your account...you would be well advised to open another "basic" bank account most users here swear by the co-op as its not the OR that closes accounts its usually the banks as once they hear of your bankruptcy..but if you open a basic account before going BR you still need to tell the OR

I thought you had to pay your fees in cash. Also, if its not too late to have your wages paid into someone else's account, you should do that. I would start drawing the money out of account now as you will need it for your basic living expenses. What time do you have to be in court? Is it possible for you to go into the bank and draw out your salary on Wednesday morning?

People here have used credit cards in the past & its been allowed by the OR but thats to withdraw cash on NOT to use the card for fees as they dont allow cheques or credic cards for fee payment...I used my O/D to the max & he turned a blind eyeWe all die. Basically I would start taking out the max you can each day if it's too late to get your wages paid elsewhere.
