Old Debt resurfaced!

Hi All,

Have had a letter from Moorcroft re a debt which I had not heard anything about for over 3 years. I know this is not long enough for the limitation law to come into affect and I acknowledge that I owe this money. However they are claiming the debt is £1500 more than it was when I last heard anything. I was in an IVA, so I believe the interest and charges should have been frozen, but when the IVA failed could they have added charges / interest again?

Can I ask them to prove the current amount owing? How should I respond? Any advice gratefully received.

    How you respond may depend on what the debt was for. Was it a CC, loan, overdraft?
    After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

    Yup, CCA is the way to go.

    You are legally entitled to request a copy of the consumer credit agreement. If they are unable to produce it, the debt is not enforcable outside of court as they have not proven the debt is yours.

    They are required by law to reply with the CCA in 12(+2) working days. If they do not produce it and are still chasing you for payment a month later, they are committing a criminal offence.
