Nat West - claiming charges after they've put a charge on my property

Hi everyone,
I'm about to complete on the sale of my flat next week. My solicitor has discovered a 2nd charge on my flat from Natwest which I was unaware of. Yes, I knew of the debt, but not of the action they'd taken - mainly becuse my neighbours appear to have been stealing my mail and there has been a number of important things like this which I've never heard about. This has come as a huge shock, and will leave me with almost no equity as a result. I am unemployed at the moment and needed the equity to support myself.
I have two questions, if anyone can help please...
1. Do you know if will be possible to try and negotiate a final settlement lower than the 21k they are requesting (grossly inflated due to interest charges added on which although frozen, Natwest started adding again on Jan 2007 apparently). ?
2. As we don't have time to enter into correspondence before I complete the sale, will I be able to start the claim back process after I've paid them off?
