TCredits if wife not from UK

Hi

I`m British my wife is not, she is on marriage visa has got NI number and everything.

Can we apply for TC? Will it be the same as if we were both Brits?

  • Not totally sure on this, but if she has a visa i can't see why not. Someone more knowledgeable may be able to help. But give it a go they can always say no if she wasen't entitled to TC.

    Yes, you should be able to.
    I am married to a Brit and originally from Australia, and we have been able to claim TC as a couple no problem.

    Thanks very much. But at the moment they are saying they cant find any records for my wife and thats why its taking so long.

    I did apply back in Feb but didn't get any money for this reason, so couldn't afford to carry on working, I went back on JSA but now have a good job offered to start on 2nd June.

    We have our first baby due in 2 months and really hope we can get CTC and WTC.

    I ring every couple of days but they give me the same excuses they were giving me months ago, wait 3 weeks for something or other.

    It was escalated by a team leader months ago, but still not getting anywhere, I don't know what else to do.
  • When you called up did they ask you to confirm her full name including middle names, maiden name, date of birth and previous addresses? (usually the one where her NI number was issued to).

    If they have taken all of this information they should be able to deal with the issue within around 3 weeks.

    It is possible that there is some sort of compliance investigation on your claim and this is why there is a delay. There is no point in asking an adviser/manager if this is the reason for the delay as they are not allowed to divulge this information.

    If it has been longer than 2 months since your form was received and longer than a month since the team leader sent the escalation you should ask for it to be eacalated again and also send a written complaint to the processing office - the adviser should be able to give you the address.
