Until I read this thread I really had not thought in depth about this matter.
Would I be right in thinking that If my common law partner whom I have a joint morgage with (both names on deeds)died, I would not be his next of kin.
His next of kin would be his 10yr old daughter from a previous marriage??? and in effect, his ex wife could get her hands on half of my (currently our!!) house??
I will be taking a trip to a Solicitors on friday I think - or get married - as suggested in an earlier post!!0 -
We changed our house ownership to tenants in common for 1 simple reason so that the goverment wouldnt get it if one of us died and the other one goes into care.
The first to die leaves their half to son/daughter with stipulation in will to
have the surviving spouse live in the house for rest of his/her natural. if the surviving
spouse goes into care the house can not be sold to fund the care because spouse only owns half of it. and nobody wants to own half a house.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
thanxs for that, my partners is in the GMB union and they do it free from a solicitors, so weve done it through them0
