maternity leave and holiday pay?

Re holiday pay, say you went on to have baby 1/2 through year, you must take all your holiday entitlement for that WHOLE year BEFORE you start maternity leave (unless co allows you to carry it forward) as maternity pay HAS to start day after baby is born.
Our HR maternity policy is that your maternity leave has to start on a Sunday, so whatever date you nominate as your date to start your maternity leave when you submit your MAT B1 form, the actual maternity leave will start on the Sunday before that.
Unless you have the baby early (like I did) in which case your maternity leave then starts on the day you give birth. And it's a good job I read the maternity policy carefully because DS was born on a Monday and after I let HR know he'd arrived early I got a letter stating that my maternity leave would start on the day before he'd been born. So I had to point out that the policy said different and that they were in fact diddling me out of a day the swines. So it pays to pay attention because they won't necessarily get it right (in fact they often get it wrong).

I'm taking myholiday at the beginning og my mat leave 4 weeks as my company DON'T carry holiday over 2 tax years- worth finding out! So it's a case of use it or lose it. So i'm having 4 weeks holiday, 39 weeks mat. leave with mat. allowance, then the rest unpaid. You can take up to 1 year but only 39 weeks are paid so if you have 6 weeks 90% pay, you then get 33 weeks mat pay. Does that make sense?

The earliest SMP can start is from the 11th week before the week your baby's due (unless your baby is born before this) and the latest from the day following the birth.
SMP starts the day after you have had your baby because it would be mighty unfair if you went to work that day, came home and delivered baby before midnight :rotfl: (in an ideal world).0 -

S'okay, although I did say that what I was saying was from my employers maternity policy - so I'm not sure how common their procedures would be with other employers. Also from the directgov website is this "Your employer might have their own maternity pay scheme. Check your contract of employment or staff handbook, or ask your employer's HR department."
