There's an interesting little line in the latest news from Martin on this site that says
"...the regulator, the FSA, has said it ‘stopped the clock’ on 27 April 2007, when it first put the hold on reclaiming and that this has frozen any ‘time bars’. This doesn’t have any power in the court, but the banks have agreed not to complain about time limits if a case goes to court, and judges in England, Wales or Northern Ireland shouldn’t consider the issue unless the banks request it"
Now am I mis-interpreting this or does it mean, at least until the issue is settled otherwise in court, we can assume that all charges levies from the 27 April 2001 and onwards can be reclaimed in theory (except in Scotland)? In practice I understand the freeze still applies so this is all academic but it would be interesting to say the least that, when the bar is lifted, court cases could be brought which consider charges from 27 April 2001 onwards and the Financial Ombudsman Service would consider charges from this period too, assuming a favourable judgement. 0

I too was wondering about this. My wife made a claim a year ago which is now on hold. So does this mean she can only claim 6 years back from the time/point of claim (if and when it's possible to start claiming again) or does this mean she can eventually claim possibly 8 or 9 or more years (depending on how long this drags on for)? Would this mean she'd have to put in a separate claim for the subsequent years since her last claim or do you think these banks will automatically pass on the "stolen" money?0
