Repossession - How Long Does it Take?

As it looks like I'm going to go down the repossession route I just wondered how long it took before you have to leave the house? Been told they are about to go to court and wondered if I will have to leave immediately following the court date or you're given some time?

firstly, have you had any papers served on you?
they must do this by law, giving you the chance to have your say in court
the first court event is for "possession" of the property, im sure you get a months notice of the court date
after that, assuming the court gives the lender possession, they have to go back to court for an eviction notice, quite often the court date is a month from the papers being served, and the court grants the order two months from the court date = 3 months from the papers being served
all in all, if youve had no papers yet, it could take 5 months0 -

Haha! Its just my natural reaction to panic! I've had a letter from mortgage co solicitor saying:
"We have issued possession proceedings against you in W'ton Court in respect of the arrear on your Mortgage Account. Non payment is in direct breach of your mortgage conditions. Fees and charges etc will be added to the mortgage debt.
If you wish to make a payment or come to an agreement please contact etc"
So I can expect court paper to arrive shortly, with a date of approx a month away for the hearing? And then after that they will have to apply for repossesion?
I thought I was panicking just had visions of getting a court date of about a week away and being evicted on the same day.0 -
you must get proper advice, call the CAB or SHELTER, they will provide a solicitor at the court, it rather depends if you wish to contest the actions.
have you kids, have you applied for housing?
get any letters and use for your housing case if so.0 -
I know a northern rock customer, he stoped paying the mortgage last june, went BR in august, they stopped going for eviction and are taking reduced mortgage payments with the arrears being payable as and when he sells the house.0

no lender actually wants to repo a house, they lose money, falling prices, fees, and repos make less anyway0

Not sure what your plans are for re housing ? The time scale Max gave is about right.Also if you need to buy time then you could offer normal payment plus say £ 50 off the arears a month ( even if youcant afford it ) This should get you a suspended possession order which would have to be breached before a second hearing for possession and then that should get you 28 days and then they would have to apply for a warrant to evict.

No, i don't intend to contest, and I live alone. I was planning to allow it to be voluntarily repossessed anyway, but they have ignored all my letters asking for info on how to proceed with this.
I have no problem with it happening, just wondering how quickly i had to find somewhere to live.

Thanks, I'm planning to rent or house share, and was planning to move out within the next month anyway, just wondered if the repossession/ eviction would force this to happen earlier0 -

There's no requirement for you to attend Court, and you'll be notified of the outcome, so I would save yourself the trouble and stay away.:D
I do enjoy going to Court, but having said that I couldn't be bothered to go when we were petitioned for bankruptcy.:rolleyes: :rolleyes:
