HI
CAN ANYONE TELL ME WHY IF OUR EARNINGS GO OVER THE LAST YEARS ESTIMATE FOR CTC I ALWAYS SEEM TO HAVE TO PAY THEM BACK. I THOUGHT U ONLY PAID BACK IF U R EARNINGS INCREASED BY 25K. MY HUSBAND WAGES OVER BY 1000 POUNDS AND I ALWAYS HAVE MONEY TAKEN OFF ME TO PAY IT BACK WHY IS THAT? I CAN APPRECIATE THAT MY CTC THIS YEAR WILL B BASED ON LAST YEARS EARNINGS BUT WHY DO I ALWAYS OWE BACK THEY R TAKING THIS BACK AT 100 A MONTH

I was advised yesterday that if your income estimate is based on the previous year then the £25000 rule you quote above does apply. If however you have asked them to enter a different estimate of income than that based on the previous year (eg if you knew your income was going to be a lot different than prev year and told them this new estimate) then they basically don't apply the £25000 rule. This was what happened in our case and they are recovering at £12/week. HTH
If you are struggling with what they are taking back you can appeal- I think it tells you on your award how to.Ermutigung wirkt immer besser als Verurteilung.

Hi Thanks
Its Disgraceful That They Can Take Back 25% A Month Off Our Award To Pay It Back And It Took My Husband All Year To Go Over By 1000 Pound And They R Going To Recover It Back In A Matter Of Months And Also I Havent Received My Award Notice Yet But My Money Gone In Today And Is 117 Pound Down For The Month.0 -
If you really are struggling then I suggest you pop to the CAB- they can speak to tax credits people for you, get explanation of what happened etc They can also help negotiate lower repayments if it is going to cause you hardship although you would need to pull together a statement of affairs (income and expenses)- CAB can also help with this. Takes some of the stress out as you have a middle man. Don't know if this helps but it's all I can think of right now. Some people have spoken to their MP too, although not sure what that involves.Hi Thanks

Its a pain this silly rule they don't point out. £100 is quite a lot to lose too.
Good luck.Ermutigung wirkt immer besser als Verurteilung.
