Firstly IS this a CCJ? For definite? Have you checked?
If it's NOT a CCJ and you have not paid or acknowledged the debt for the last 11 years as you say then it's statute barred and you don't HAVE to pay a thing :)

  • hello,

a mate told me bailiffs turned up at the address looking for me in 1997, tower inv' asked if i lived at that address! so this probably means a CCJ has been aquired even though i have a mortgage and bank account? i denied living there so i presume they will contact global (misery) recovery, who will try and con me, but i have you cool dudes to help

That doesn't mean it's a CCJ - unless your mate saw proof they were bailiffs... Seriously the amount of DCAs who are happy for people to get the view that they are bailiffs (although this is illegal) is quite shocking.
Do you know what court would have issued the CCJ? Is there no record on your credit files? I'd have thought if a CCJ was issued then this would have been highlighted when you got the mortgage! My OH had a default (incorrectly as it happens) on his file and the initial mortgage application we made last year when re-mortgaging got turned down because of it. We got it corrected but lost the great rate offer we had at the time and couldn't do anything about it...
I'm sure there is a website somewhere that you can search for CCJs on... hmmm maybe someone has the link... :)

If you have made no payments towards this debt in a 6 year period and not acknowledged the debt in writing, the debt is statute barred.

If this is a Debt Collection Agency chasing the debt, you just need to inform them that the debt is statute barred and no longer enforcable.

If this is debt has a CCJ against it then unfortunately it doesn't become statute barred. However, if the CCJ is 6 or more years old then they would need to reapply to the court for permission to enforce the debt. They would need to come up with a pretty good reason to convince the judge that even though they have not sought payment for over 6 years, they should now be able to outside of the 6 year timescale.

post 18 sums it all up.

    thanks mrstine,

i dont know if there is a CCJ in that case, that is a big relief just knowing that. i was just at my mum's and tower investigations called them. i'm off with my nerves and can't help but worry, silly ehhh

hi smashedbooboo, unfortunatly it is the same lovely company but its still with tower who they must use to find there victims. infact they must have 1471 for my number and asked my dad questions when my dad asked where he was from he said "scotland"..... fly get. my dad insisted he tell him what company he was from, he just said i have his(my) number and repeated it to my dad. then he said "it sound like you don't want to tell me anything and put the phone down".
i have now started the process of changing to a ex-directory tel number and will ignore them until i have to deal with it as advised.
