Tenancy Deposit Protection Scheme - Scotland

Can anyone tell me if the Tenancy Deposit Protection Scheme applies to Scotland?

I have a letting agent who has still not returned my full deposit after almost two months and is giving me the cold shoulder. I moved into the property in Nov 07 so should this have been protected in a scheme and should I have been informed?

Also if anyone can point me in the direction of where I can find information of how these schemes work in scotland it would be a great help.

    Unfortunately the schemes are not applicable in Scotland.

    You can seek advice from Shelter Scotland, CAS or your local Council Tenancy Relations Officer for private rentals.

    If you have not already done so put your request, for the return of the deposit in full, to the LL/LA in writing (send rec del or hand deliver) Simply state the date of your tenancy, the date when you moved out, confirm that you left it in good order and all billls & rent were paid up to date, say who checked the property , and say in the letter that you would like payment within 7 days. You are only obliged to leave it in the same condition as at the start of the tenancy, fair wear and tear excepted.

    If they want to make any deductions they have to confirm them to you in writing, and you can challenge them if you do not agree (again you do it in writing) Re-iterate request for repayt in second letter then ,if still no joy, you send third letter saying that you will pursue reimbursement through the small claims procedure at the Sherriff Court, adding on the costs to your claim.Keep copies for your own records.

    Your LL will have to have registered as a LL under the recent Scheme so you can always send copies to the registrars too.
