Hi, can anyone help me a year ago i lost my job and was unable to repay a bank loan with hsbc i stupidly thought this debt would dissapear and ignored all letters! When the letters got really nasty i told myself this could not be ignored and phoned up the company who had bought the debt from the bank ,we came to an agreement to repay the debt by monthly direct debit, as far as i was concerned this amount was being paid everymonth until i recieved a ccj this morning! I phoned the company who had taken me to court to be told they now owned the debt and as no payments had been made since febuary this was there action! When i explained about my agreement with the previous company the man told me that was between me and them, but they now owned the debt and i had made no agreement with them when i explained i thought this debt was being paid off he got really nasty saying that was not his problem and unless i could pay all the £3500 off in one go the ccj would go ahead! i explained i was a fulltime student with 2 children and a single parent with no income, he told me "well borrow the money off someone"!! i dont know what to do i cant afford to pay this amount and cant afford a ccj against me pleaseeeeeeeeeee any advice im at my wits end as just or as i thought got all my finances sorted!

Contacted the company again today to see if there was any light at the end of the tunnel but got no furthur! They said if i had not ignored all correspondents this action would of not taken place, when i explained i had recieved nothing from them they practically called me a liar! Only solution they gave me was if i paid the sum of £2500!!!!!!!!!!!!!!!! in the next couple of weeks/ or pay them £400 a month they would withdraw the claim of a ccj, i tried to explain i could not do either of these as only recieve just over £400 a month in tax credits/family allowance but they would not help me at all! Contacted my local cab but cant get appointment till the end of next week so time is running out for me as only have 2 wks to stop this ccj killing me for the next 6 years!!![EMAIL="abuse@moneysavingexpert.com?subject=Reporting%20post%20http://forums.moneysavingexpert.com/showpost.html?p=11073373"]

Hi i recieved all the forms on monday so no not gone to court yet, well dont think so dont know how these things work!0

ok.
have you CCA'd them to see if they can legally collect the debt?
you will need to defend the claim (if you want to) within 14 days. this will give you another 14 days to get all the info this company have on you!
the other thing is, your credit score will already be affected by this debt so do not worry too much about a ccj.
i can help with the claim form. i am not an expert but i have been through a court claim and it has been struck out!!0 -
Thanks for your help, company made it sound so scary threatened me with baliffs if this was not sorted out within the time limit also said they could reject any offer of payment i made on the claim form if they did not think it was enough! know this sounds stupid but loosing sleep over this, took a LONG LONG time to get myself on the straight and narrow since my marriage break up dont want to go back rather than forward.0

Hi. Firstly don't panic. We're all here to help and offer support. I can't help on the legalities of this but CCA'ing them sounds like a good idea as it will give you a bit of breathing space.

please please do not be scared. that is their job. if they scare you enough you will pay what they say. i learnt this lesson a long time ago!!
baillifs can only be called if a ccj is granted and you then default on payment. the creditor then has to go back to court to order bailiffs! that is a long long way off IF it gets that far!
another thing - NEVER talk to them on the phone. as you have found out, they try to intimidate you. keep everything in writing only especially as court papers served

By the sound of them they are heartless scumbags. If you have paid the last debt collectors and the account passed to another dca then that money should be reclaimed and paid to the debt collectors who are hounding you now.
There will be more MSE WITH MORE KNOWLEDGE THAN ME TO HELP.

As louise1111 says - never talk to them on the phone as they will bully, threaten and intimidate, I've also learnt that lesson. Keep all letters and copies of letters that you send. Demand everything in writing.Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free
