OR still not informed creditors........

Went br mid march and still being hassled when i tell them i am br and or is dealing with it they all say they have not received or been given this info. Is it normal to take this long?

  • Its more likely that they are
    a) ignoring the contact from your Or
    b) the message hasn't been passed on to all depts

I'd say a) is the more likely one though.

Why not email your OR and ask if its been dealt with.

When they call again, tell them your Br number then tell them to stop hassling you or you'll be forced to report them.

    Good luck

i ran of 30 copies of my BR, and sent all who had written to me a copy with references, etc

1 has written back "we have not yet had full instructions regarding this matter from the creditor from initial contact in january"

so why the hell write to me?

Moorcrofts (acting for RBS) rang, left a voicemail so i rang them, after 10 minutes trying to tell them i WAS bankrupt and that i WAS listed on the IS website they STILL wanted the BO number and a copy posting, I said forget it, keep ringing mate...

I had Eversheds write to me yesterday saying we've taken on the debt you had with barclaycard and we will only be dealing with your trustee, if you have any queries or questions about this letter DO NOT REPLY.

    Go figure

I guess there's some legal standpoint that they had to tell me but seemed a bit weird :)

As for creditors still contacting you, everytime they contact you, inform your OR as they're not supposed to and your OR really needs to deal with it.

I thought they had about 90 days to contact all creditors but I might be wrong?

The only company that were awkward with me were Moorcroft but that's hardly surprising as they are just plain evil.
They claimed that they hadn't heard from the OR but after ringing the OR up it was confirmed that EVERYONE had been informed. I put it down to Moorcroft just been pathetic chancers as per usual.

I also had a letter from Evershed re:Barclaycard. What made me laugh was that the Barclaycard debt was less than £300!! Surely a company like Barclaycard could just write that off as experience??!! :rotfl:

From what i have read eversheds buy debt in bulk at a fraction of the cost. So say your deb was 10k eversheds buy it for 1k off barclays(sometimes they do not tell eversheds you are actually bc:rolleyes: )with the hope that out of say 50 debts puchased, they will get a %££'s back which makes it worth their while.D

OR has 56 days from date of BR to issue the report to creditors, so it may only have just gone out.
  • The legal limit for OR to send out the report to creditors is 12 weeks but JCS1 is correct that the organisational target is for the RTC to be issued within 56 days (8weeks) of the Bankruptcy Order.
Yes they are probably trying it on. Tell them your court and number, that you are not going to speak to them anymore, put phone down, dont answer number witheld calls. For letters that arrive after 10 weeks forward them to your case officer at the OR's office and write on top 'please send RTC' and your case number.
I would not keep calling the OR asking them to stop creditors calling you. The creditors ignore the OR's staff too! And unfortunately we dont have the resources to do any more than send the RTC. Too many cases not enough time I am afraid.
