mercers please help

Had a letter this morning from Mercers debt collectors collecting on behalf of barclaycard . They say they are instructing a local debt collector as my account is overdue and they have not been able to contact me . They say to ring as it will prevent the collector from calling . Please can someone advice me what to do . Thanks

    Mercers are Barclaycard and the chances of anyone visiting you are slim to zero.
    Assuming there is a debt have you contacted B/Card to make a repayment arrangement, see if they will freze interest etc?
    CCCs, Paypan and National Debtline all offer good, free advice.
  • Thanks Leixlip , that has stopped me paniking I was worried someone would be knocking on my door and taking all my belongings .I have written to barclaycard with my income/expenditure sending a cheque with what i can afford which was cashed today . Shall i write to Mercers ? or not. I have had nothing from barclaycard . Thanks

    Mercers have relentlessly tried to contact me over a 6 month period, eventually they sent 2 meatheads around the house. Fourtantly i was out. So i relented and called them, now on a payment plan.

    I wouldnt bother avoiding them because they will harass you and call you every day. It's not worth the hassle and stress. Just pay them something each month no matter how small and they'll leave you alone

    Send them this letter by RECORDED DELIVERY:

    Your address

    Date

    Creditor / DCA's address

    A/C Ref: XXXXXXXXXXXXXXXX

    Dear Sir / madam

    Please be advised that I am only prepared to communicate with XXXXXXXXX in writing. OFT rules and regulations clearly state that you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.

    There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; e.g. the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).

    Therefore take note that I revoke license under Common Law for you, or your representatives, to visit me at my property and if you persist in sending "doorstep callers" to my home, you will be reported for harassment and be liable for damages for a tort of trespass.

    You would also be liable for conspiring in a tort of trespass by acting in defiance of my instructions and sending someone to visit me nevertheless.

    Should it be necessary, I will obtain an injunction

    No, not unless they ask for it.

    You could request your CCA from them, this will put your account into dispute, which means they cannot take any action until resolved.
