    I had always just asked for CCA in the past. Have now sent the NDL letter, with my £1 postal order (no point giving them my bank account info on a cheque - don't trust them enough!) and sent it recorded delivery. Will see what happens.

    Hi all - I haven't been on the site for a while and usually lurk around the DMP support thread but I need advice and don't want to scare any newbies on the DMP Support one.

    We have had a DMP since Nov, Citifinancial were accepting our payments, now the debt has been assigned to 1st Credit. My OH made the rookie error of phoning them (not knowing their reputation!) just to find out how to pay the DMP to them - biiigggg mistake. Threats galore!

    Anyway we will deal with all that rubbish, but one practical question? We want to pay them the DMP amount we were paying Citi as we are not allowed to pay Citi anymore apparently. Even if 1st Credit don't "accept" the amount (and it sounds like they never do) - will they actually give us a reference so the CCCS can make the DMP payment, or do they not let you pay them?

    From what I can tell Notenoughcash is paying them?

    I just want to pre-empt any rubbish coming our way!!

    It's very difficult to pre-empt any rubbish - especially from a dca.

    They are, most likely, going to pressurise you to make a higher payment. I see that you are in a DMP with CCCS, in which case I would speak withh CCCS, as it is against the OFT Debt Collection Guidelines to try to pressurise you into paying any more than you can reasonably afford.
    Equally, they should deal with your nominated third party (in your case CCCS) who will be more used to dealing with the likes of 1st Credit:

    Not sure if this is a good thing or not?

    Either they haven't got the information about the CCA, or they have passed it back so 1st Credit can take court action.

    Another thought, should I have something about the assignment of the debt. Have never had anything from 1st Credit, only Connaught, and still don't know who CitiFinancial are.

    Being passed back to original lender seems to be the usual result when you send a CCA request in the way you just have - recorded delivery etc.

    If there's no CCA to begin with court action is unlikely, but it might not stop them. If in the future you should get any court paperwork through for a CCJ then reply asking the court for more time and sending the CCA request to whoever is trying on the legal action. Don't forget it is up to them to prove any debt.

    Connaught probably sent you a notice of assignment. 1st Credit should have notified you that they were passing you on to a DCA. If you think about it anyone could send out a NOA and start getting money diverted from its proper places if that's was all that was needed. I've recently found out that failure of the original lender to notify you that they're passing you on to a DCA is against OFT guidelines. That reminds me I must ring ND tomorrow to find out how to complain to the OFT!

    I have quite a lot of debt (about 6 creditors now) but my situation changed about two years ago and I contacted all my creditors and have an agreement with them all, which I have slowly increased my payments on as my situation has improved. Altough it is at a standstill at the moment. It is all unsecured debt, but I have also been cursed by first credit. I originally contacted the creditor and they rejected my proposals, so then I was contacted by a debt collection service, they agreed a payment amount and I was paying them for about three months when they told me that the debt had been sold to First credit. I have spent about 6 months trying to agree payments with first credit but they wont agree to anything but a payment in full. I have just received a letter this morning from connaught collections. They say they have the intention to issue a statutory demand as they are unaware of any valid reason for non payment (pah!!). Then it says can I call to arrange a convenient time and date for service? If i dont contact them in 7 days then they will issue it regardless. How should I respond to this? When I started managing my debt myself I followed the national debtline guidelines and this worked for all my other creditors who I owe similar amounts to. It makes no sense as I have absolutely zero assets and savings etc. and am currently unemployed! Can someone advise me on what I should do next? Do i need to explain to them the situation etc. as I have done so so many times with first credit or should I wait and see what happens next? I a totally confused.

    Good news , keep all letters . You may hear from another DCA , but just just tell them no CCA has been provided .

    Hi, further to the above re: 1st Credit via Connaught Collections Continued to send the 12+2 etc. to Connaught who kept on replying that I needed to contact 1st Credit. Would not do this as had not been notified.

    Because of Connaughts actions, Statutory Demands etc. decided to include 1st Credit in DMP on advice of CCCS - they have now told CCCS that I have quoted an invalid account number and they need the right one. As the only reference is from Connaught, have given them this, and they have told CCCS that they cannot find my account with this info.

    So now, as far as I am concerned, they don't know who I am, can't find my details, so they don't get a penny.

    This looks to me like they've been trying it on all along. At least now, if they do pursue this to court, which I doubt, I can show that i've done everything I can.

  • Help!!!!

    I have just had a delivery I had to sign for from Connaught Collections for 1st Credit for the amount of £1,210.94 the debt it is dated 05/06/05...I have either 18 or 21 days before I am made bankrupt by a Mr.D.Silcock...what do I do?????
    I have no way to pay this debt in full as I am only on Incapacity Benefit...

    Grateful for any advice...

    Is it a warning letter or official court papers?
