Wrong Details On Parking Ticket- Private Company

hi, my oh received a letter from a private parking control company fining him for parking without permit/ payment.

he claims he would have definately returned to the car b4 the time expired...... (im not so sure!).......:p

anyhow 2 things i wanted some advice on;

the car is named on the fine notice as a vauxhall cavalier, it is actually a vauxhall vectra? any technical get out on this? :D

secondly, and more importantly, the accompanying photo is of the rear of the car, so how does it prove that the dash board did not have a valid ticket displayed? :confused:

  • Write back to the company and ask them for details of the driver and that when they provide that you will forward all correspondence to that person.

    Contract on private land is between owner and driver - not registered keeper. You have no obligation to tell them who was driving on that day, so basically you can ignore it.

    A private company cannot fine you. Ever. For anything. They can only invoice.

  • The registered keeper is not liable unless on a public road/land (ie police/parking warden)

    Its private land, its contract law, and the contract is formed between the owner of the car park and the driver - not the registered keeper.

    The registered keeper is under no legal obligation to tell them who was driving. They are chancers after your money, and have practically no chance of getting it.

    Do a search, plenty of info on this forum.

    Agree fully with pew pew. It is the driver who they have to try and get the money from not the registered keeper. So just return the form or whatever they sent to your OH as pew pew says asking fro details of the driver who you will then pass the correspondence on to.

    ON NO ACCOUNT pay them any money or admit who was driving the car. They have no right to this information so do not help these greedy money grabbing sharks by volunteering any information.
