Its my fault, but can I reclaim?

Hi,

I had an account with all & Lec Last year, My wife and I decided to get a joint account with a different bank to make managing funds easier.

At that time I intented to keep my a&l account just for the benefit of the delta card.

The account was £84 overdrawn but had a £100 overdraft limit so I wasnt worried.

We moved house 3 months later and id forgotten all about this account, then today I had a call from A&L stating I owed them £357.

I accepted that I had forgotten about and not used the account in almost a year but protested that they had left it this long allowing charges to accrue without notifying me. They said it was upto me to call them. I accepted this and agreed to give them £100 which I felt was a fair assessment of what I owe.

They say I have 30 days to pay the rest. Is it worth me fighting this?

    id say of course it is, have a look at the reclaim threads and you will see its worth a shot, ime going to claim my charges okay it may take a few letters but still worth it - read somewhere here that the 5.00 underfunding charge we cannot request to have refunded as its part of the account i hold, not sure if its the same for you, but the charges of 5.00 daily over the overdraft limit, and the failed ddr etc of 34.00 and 25.00 we can, those are the ones im requesting.

    I assume you didn't tell them about your new address? If that's the case then I can't see how you can complain that they didn't contact you.

    If they charged you 'unfair' levels of charges (e.g. £35 a letter etc.) then I think you're perfectly within your rights to make a claim for the excess (over and above the fair value of £12 or so). However if they wrote to you and charged you for letters that you didn't act on then I can't see what your claim is.

    They're certainly entitled to charge interest on the £84 and also interest on the unpaid charges (but, again, only to the degree that those charges were fair).

    What would be useful is if you could summarise the exact dates and amounts that you were charged what (and from when you last 'saw' the account), and then we can probably calculate a 'fair' level of interest and charges.

    Do you really want your credit rating ruined for the next six years, for the sake of a relatively small sum?

    I would pay the £257.00 and have the account closed properly. Then you can sort it out in your leisure. Among the lot are probably charges, not only interest and under funding fees. Those claims are on hold right at the moment, until May 22<SUP>nd</SUP> at least and in all likelihood for much longer. When the whole mess of charging has been sorted out, then you can or (as the case maybe) cannot re-claim those charges.

    Do not listen to those who say “go for it, at all cost”. It’s your credit rating that hits the cellar.

    yes you are right bengal-stripe i should have said also pay the account off for now but consider the claiming.

    yes the credit rating is important too.

    i apologise to thewarden if my post was not as clear as it should have been -

    like i did say others will be along who are more experienced, just like you bengal-stripe.
