Husband going bankcrupt in divorce

Hello there,

I was hoping somebody might be able to offer me some advise?

I am divorcing my husband due to domestic abuse and since the separation he has cashed in assets in excess of 70K ... saying he had to pay off family debts (which did not exist)!!!

He has since our separation accumulated a number of debts, god knows how since he had not been paying the mortgage (even though he was ordered to) and during our marriage we had no debts apart from the mortgage.

He has now quit his job paying 45K per year and is filing for bankcruptsy!!!

He is making sure that my child and myself will see nothing and will not have a roof over our heads.

He does not financially contribute towards our child or towards anything ... no CSA no nothing.

I have increased my hours to make ends meet, but am afraid I am going to lose our home.

Is there anything I can do to protect myself and my child from his actions.

I would really appreciate anyones advise.

    When did you separate? Do you have evidence to state no debts at that time? Credit report, bank statements etc? When did he cash in his assets? Have you advised the OR (Official Receiver) of this?

    You need to get your right to live in the home under some marital home act placed on your deeds to prevent him taking secured loans out agains tht house. Don't know any more but my friend did this after her ex took out a loan on the house and walked off with the money.

    We separated a year ago. I have evidence that we no debt whilst married. The trouble is he is pretending that he had old family debts - all new to me and obviously made up to dispose of assets.

    He has applied for bankruptsy but I was wondering if I could intervene with the proceedings. So I cannot tell the OR until he is allocated one.

    I will look into the marital home act ... thank you for that tip.

    Try posting on the Bankruptcy board for more help with possibly "interfering" or advising the OR...someone there may be able to give you more advice.
