Tile size difference!

Hi all,
I recently bought some bathroom wall tiles from a large DIY outlet and half way through the fitting the plumber noticed that quite a few were slightly different sizes.
The plumber has been a family friend for a long time and I take his word as gospel really, the tiles were too far out that when grouted they would have looked stupid.
Bearing in mind I bought 16 boxes and 6 of those were now on the wall, I contacted the DIY store to see what to do. They suggested I bring back the 10 boxes and they would refnd me the full amount, quite reasonable I thought.
Obviously this caused the plumber a lot more work, 2 days in fact, because he had to chisel off the tiles and get the wall in some sort of shape to start tiling again. I discussed with the DIY store and told them I would be bringing a bill in from the plumber for his time, as I certainly wasn't paying for their incompetence. They accepted that but said that they would have to contact their supplier to regain the money from them before the plumber could be paid.
For some strange reason they only sent 2 tiles,out of the 10 boxes, to their supplier for examination. This is hardly a true representation of the amount of tiles that were unusable. They then sent me a letter saying that the 2 tiles they had were within the European Standards and were not not sufficiently disimilar. I have now demanded that the DIY store send all the 10 boxes for testing and the store manager responded by saying 'your plumber should have checked every tile before fitting them'. I responded by saying that if that were the case then the staff in the store should have checked every single tile before they sold them to me, as they were unfit for purpose.
As you can imagine I am very annoyed, has anyone got any ideas what I can do?
