I can see the only way you'll get any further with this OP is if you SPECIFICALLY asked when you bought the second item "Will this item match the other part I purchased x months ago?"

You may have some prospects then - I'm not certain though. Like others have said, you're getting a pretty good deal as it is (i.e. like with wall paper etc, they won't guarentee a perfect match between batches - I would imagine upholstered furniture is the same) as they are probably under no legal obligation to refund you anything.

    Issues with the sofa:

    1) We asked at the time of purchase of the original part whether the range was likely to change. We were told not.

    2) It's not just that the halves are different colours - as a modular sofa, they should connect together. Between buying the first part and buying the second part, they have changed the design of the sofa so that different connectors are used. The pieces do not fit together. This is fine for us, but I imagine it would be dangerous to those with small children, as they could easily become trapped in the middle.

    3) I wasn't expecting the colours to totally match when we bought the second piece. One half is brown though, the other is purple. It's not just a case of different dye lots, it's a case of totally different fabric. The manufacture is also different - the cushions are made of a different foam. (upholsterers daughter, these things have been drilled into me from an early age)

I'm aware that 'we' didn't buy the sofa, but the gift service was set up specifically because we liked that item. However, I don't think that they would offer a refund to my mother and father who put in the majority of the cash because of their shoddy service.

You'd probably have more luck with the second item (the different fixings) on an "unfit for purpose" angle, however, this would again hinge on fact of if you asked at the time of buying the second piece "will this connect properly with the piece I bought x months ago?"

It isn't really a valid question at the time of purchasing the first piece "is this likely to change" as most (all?) companies have a policy of continious improvement...

item unfit for its purpose and you were not advised beforehand of the change , etc epsecially in the color

also in view of the fact that the matter has been protracted - i assume more than 21 days then your rights to a refund is not restricted to them giving you vouchers back - they will have to cough up out of their own pocket

They dont have to advise in advance of changes in a range

If the OP had asked and they lied then they may have a claim but if they simply assumed there would be no minor differences then tough

If someone went in at that time and bought 2 parts it would have been fine therefore it is fit for the purpose

Your argument would be like saying a playstation 2 controller must attach to a playstation 3

    Ah right.

Well - as far as I thought then sale of goods act specifies that goods were fit for purpose. As the goods aren't fit for purpose, I'd thought that legally I was right in getting the money back.

I asked the question as the trading standards website says that:

    Q. A consumer paid for an item using gift vouchers, and he/she has now found that it is faulty. Can the trader insist that the consumer accepts the refund or compensation in gift vouchers? A. No. Where a consumer is entitled to claim a refund or compensation, he/she is entitled to cash. A cheque will usually be acceptable (or a Postal Order for consumers who do not have a bank account).

I just wondered if anyone had any further experience of this.

I'm not actually sure they're right with this. Also every page that has this written also at the bottom has:

"This leaflet is not an authoritative interpretation of the law and is intended only for guidance."

You could try and argue the TS statement but ultimately it would be up to a court to decide what is right or wrong. You paid for part of the goods with a gift voucher so what is the problem with receiving the money back on one, you will be no worse off.
