Deposit Court Action Question - multiple claimants?

Hi there,

Me and my 2 old housemates are planning on taking our landlady to court soon as we have not had our deposit back after 2 months. We have sent letters and last week a "Notice Before Action" letter. The deposit is also not protected.

The AST was under all our names.

I just wondered are you allowed multiple claimants on the court form? Can Mr X, Y and Z submit one form, or just one of us to represent us all? Is Mr Xs deposit, Mr Ys problem?

Or would we need 3 separate claims?

Any help appreciated!

    I raised a court order on the other way around (on ex - tenants) and I had toto name everyone( Mr and Mrs and guarantor) but it only cost me the one fee and it was the court that sent out indiviual copies.


    As each of you have a claim against the LL then I think you all raise an indiviual claim, so you will have to pay indiviual fees - but if LL loses they will have to pay each cost back AND get 3 CCJ's at once!!

    Agree with Clutton ask the courts they are normally helpful but only open something like 9.30 to 4.

    Thanks for your replies.. but today 3 cheques were on the doormat, so as long as they clear there is no need for court action!

    The landlady also sent a separate letter, and had the cheek to say "this is a matter between the letting agents and yourselves!

    Oh well, there goes the non deposit protection claim of 3x deposit! :cool:
