MCOL or FOS??

Ok so which is best? Im trying to claim £386.66 from Mint which is including the charges and the interest. They have agreed to refund me £29.74 which is pitiful really. They told me on the phone today that they are not going to pay me the full amount at all (even though i told them that i would settle for the charges and not the interest which works out at £324).
Now, here are my questions, as it was discussed over the phone do i wait until i receive the letter confirming this from them before i file my claim? Also which is the best way to reclaim my cash the FOS or via MCOL? I know the FOS is free but mint say the FOS wont dispute charges of £12, which is incorrect based on what ive read.
Any ideas?

Hi,
I went via MCOL on three occasions. Cap1, Citi Bank and GMAC. For Cap1 and Citi Bank going via MCOL worked. I got letters within two weeks of filling the online form in saying they would refund the full amount. Gmac is a different matter as it is for mortgage charges and they are going to defend all the way.
My advice for what it is worth is go via MCOL if you can pay the fee.

Hi,
I stuck to my timetable. If they hadn't replied within the two weeks I went ahead with the MCOL.
