***UPDATE***
My wife bumped into the neighbour of our buyers and was told that the problem with the kitchen extension is that the sewer pipe in the concrete floor ruptured and flooded the kitchen. This was something that we didn't touch as the footings and concrete pad were already there and we just replaced an existing structure.
I haven't heard back from my solicitors yet but from what I've read on this forum a Building Regs Indemnity Policy will not cover that sort of situation. Which sort of reinforces the view that I shouldn't pay for one...

Our solicitors finally got back to me and told me not to worry about providing the £35 for the policy as they will not be pursuing the matter any further.
