Righto.
Recieved a new letter from Link financial. Informing me that I should contact them IMMEDIATELY - if I do not, they will consider selling my account to an external agency who will take the appropriate action to recover the outstanding balance. Or they may issue proceedings via the county court.
Anyone got any advice (AGAIN, I know!!) pretty please?0 -
2nd - seems like a fishing letter. Don't confirm, don't deny. If they are chasing you for a specific debt, you'll soon know about it.
I've recieved a 2nd letter, detailing the loan and noting they have been appointed collection agents for the balance.
Do I need to follow the previous method in ascertaing that they have the original credit agreement etc ?0 -
Sorry to BUMP but anyone help out here ?? Cheers0

Again, can i ask for a small recap?
You requested the CCA
They replied stating they needed 6 signatures from you
Did you send a letter telling them to go jump?
Had you sent the 12+2 days template letter
And the 12+2+30 days template letter?
There is something in one of these letters that points out that it is against the OFT debt collection guidelines to pursue or sell a debt when it is in dispute.
Did they ever send back the £1 postal order? After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
Dad Gift 6k ¦ Savings & Inv Tst: £2,500
Loan 10k: £0 ¦ Dad 5.5k: £2,270 ¦ LTSB: £0 ¦ RBS: £0 ¦ Virgin £0 ¦ Egg £0
Total Owed: £2,270 (+6k) 11/08/20110 -

1st Letter sent to Asset Link, sent 16th May, replied to on the 30th stating that as they can not confirm I am Adrian Brooks they will not send out the CCA - however if I provide 6 specimen signitures they will do so.
Postal Order not returned.
2nd Letter sent 11th June (This contained the bit about OFT).
3rd Letter - looks like I missed this one
Letter recieved by me on the 7th July - many apoligies but this is not telling me it's been sold but that I need to contact them immediatley or else they will

Should I send the 12+2+30 letter now ?? Anything else I should do ?0 -
I'd send this letter to them

and possibly remind them that they should not be passing on a debt that is in dispute to a 3rd party. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

Thanks - will send off on Wenesday. It's like an annoying itch this one. If it was mine I would have no issue with paying, just the circumstances are slightly anger-provoking.
I'm wondering tho, with this new letter from a different company, do I need to ask them to produce the same documents and take it from there ?0 -
If a new company writes requesting payment for that debt, then yes - back to square 1 and requesting a copy of the CCA. It could go through the hands of a few DCA's before you either get a copy or they stop hastling you. Only 5 more years until it's statute barred...After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
