CSA

My Fiance and his ex split when she was three months pregnant, she lived in my partners house, (he payed mortgage and bills) when thier son was born, he transfered the property to her and she continued to pay the mortgage, the equity of the house being for thier son!
he is now paying maintanence as expected, and is assesed unter the new scheme, however nothing is mentioned about the transfer of properties or equity on the new scheme only if it was part of at settlement prior to 1993, I'm all for supporting the children, but were concerned that this won't be taken into consideration in maintenance reductions, and he would have transferred the equity and still paying out more than he needs to (either in a larger mortgage to cover the shortfall and full maintenance)

    thats correct any large one off "gifts" to the ex are no longer taken into account. as you so rightly put since 1993. this has been law for many years now.

    there is nothing you can do about it now, presuming your fiance handed over everything after 1993.

    I cant find anything nice to say abt the CSA and i was the parent they were supposed to be helping .. there interference nearly caused my child and her father to stop seeing each other as they were fleecing him to the point he had no money to live on or to travel to see his daughter .... There interference has put a barrier between us all now that has caused nothing but problems

    Wouldnt it be easier if the CSA werent involved in maintenance at all? i think we all agree they expect too much to the detriment of all concerned. Unfortunately, when absent parents refuse to pay maintenance there is no longer have the option of applying to court which only leaves involving the CSA. I for one would prefer voluntary affordable payments but sometimes the choice is CSA or nothing.

    My ex of 10 years has never paid maintenance. He has worked, but cash in hand so does not show up as paying tax and therefor can't be traced. He has been studying for years and so is not claiming benefit and students don't have to pay anything! I have done nurse training, a degree and a masters whilst supporting his kids. Now he is working. I contacted CSA over 2 months ago with the detatils of his employer. But as yet I haven't heard anything. It's so frustrating. Appently it's not a new claim cos I tried a few Years ago.
    I understand how frustrating it is trying to sort it out. Solicitors won't get involved cos of the CSA but they don't seem to want to know either.

    Judi,

    I'm in a very similar position to you and it's very frustrating.

    It seems to me that the non resident parent who wants to pay gets shafted and the non resident parent who pays nothing gets off scot free. :mad:
  • Me and my partner have just split up becuase she slept with the next door neighbour!

    We have a 2 year old son and I will do everything in my power to keep the CSA out of our lives.

    I earn a good living and going off advice from my solicitor we can make the maintainance payments as official or unofficial as we like. Fortunately, things are ammicable between us and we are both happy with an agreement between us saying how much I will pay each month (15% of nett wage). I will still have this put in writing just in case something goes sour down the line but I have heard so many horror stories about the CSA that we both agree that we do not want them involved.

    Just as a side note... if we both type something up together saying how much I will pay each month and how often I will see my son etc, will this cover my !!!!!! (as long as we have both signed it) should things turn for the worse down the line??

    You just need to get the ex to sign something to say that you pay her maintenace and how much and when, it will just protect you further down the line. Might even be a good idea having it paid direct into her account so if ever the agreement goes missing, you still have proof that you pay maintenance.

    Is you're ex working ? if so she will have to declare this money to the benefits office and it will be taken into account.
