default notice due to charges

I have already put a claim in to my bank regarding charges, but have been refused a mortgage recently due to a default noticed being lodged against me by my bank! I have an outstanding overdraft on an account that my bank have closed but the charges they may owe me are far in excess of the overdraft! the claim against me has been put on hold by my bank pending the test case result but still maintain the default notice which has severely hindered my earning potential when i am a builder that does property refurbishment! Can the bank do this? and can i request that they remove it?

The current Banking Code (Section 13.6) states: We may give information to Credit Reference Agencies about the personal debts you owe us if:

• You have fallen behind with your payments,
• The amount owed is not in dispute; and
• You have not made proposals we are satisfied with for repaying your debt, following our formal demand.

"

That basacially means that they cannot contact the credit agencies in regards to your account while you have a dispute with them concerning monies owed.
