I have always thought you can cancel within the cooling off period without incurring extra charge, but it seems to be not the case when you buy financial services. Swinton are brokers and I think, though not quite sure, will be ready to defend themselves in a court of law, should the matter gets their, as this charge is an adminstration fee, not a penalty one.

I have been in your position before, but, I was arguing it was not mentioned to me when I bought the policy and I was not ready to fight for it as I had no time for it ( moving house)

You can, rightly or wrongly, take them to court if you want to. They might settle before then as it is not financially viable when it is £40, but they might go for it if they have strong grounds to defend it.

I would recommend posting on the insurance board as you will have a more specific, may be professional answer than what I said.
