Post 2 and 4 both seem to think that his ex would have to pay it back herself; do you know who's right, because I don't. Also the OP doesn't seem bothered whether the money comes from CSA or the ex (read her first post).
I'm sorry, I seem to have wandered into a taping of Jeremy Kyle, I think I'll just wander out again!!0 -

seeing as you have no idea about the relationship involved in any of this.. its no concern of yours really as to what im bothered about. Im asking for advice not judgement.
Thank you to all the other people who have been helpful
For your information if the childs mother can afford to run 4 decent cars, then shes doing pretty well,
and the fact that she has willingly taken money of someone for 2 years knowing full well hes not the father is wrong.0 -
I agree the ops partner should not pay any more money towards the child. Its great though if he will carry on seeing him, althogh it would take a strong person to do that, im not sure if i could, it would hurt too much. Does she have any idea of who the father is, what happens if she doesnt know who the father is? I hope all works out well for you xx
My friend who ive know for some years only knows the first name of her childs father, the father she thought it was the dna test came back negative. Hence an extreme difficulty. It has caused a lot of probs basically, she cant claim csa as she doesnt know the fathers surname, she was only young, as far as i can make out she was extremely insecure, she tells me it never even crossed her mind to find out his surname, it was enough that he liked her enough to sleep with her, i know, its extrememly sad, as in upsetting sad, a nightmare eh? xxx0 -
Csa as many people say is such a waste of time.

I personally wouldnt pay any more money saying that if dna says he is the father then fair enough but not until then as you have no hope of getting any money back you have already paid. Im sorry but nobody should be made to pay for a child that isnt theirs unless they knew from the outset that this was the case and wanted to still treat the child as their own, its not his fault that he was unaware. They is nothing stopping him treating the child should he wish and be allowed by pwc that is totally different.0

Unfortunatly he has to pay the money as they are taking it out his wages

I just want to bump this up and give a update and see if anyone else has any advice, The csa have started t o take money out his aco!!!!, so he is now in a - and he is on a IVA , so we are contacting them and seeing if they are able to reduce payments,
CSA are waiting to hear from the mother, as she is dening recieving letters, so they are sending one out recorded delivery,
Now the csa person said that if she doesnt do it, he would have to go through the court?
so does that mean the csa case will be dropped? and he can start getting the money back?0 -
the csa wont refund anything, same as if they cant back date to birth any money owed to the parant who's claiming ,only from when they 1st got the claim in.
i pay my first 2 kids private,
the 3rd went to the csa because i wouldn't pay her cash in hand,
when they 1st assessed me they demanded the total as if i only had 1 child,
they wouldn't accept that i paid to my other 2 unless they went through the csa,
so instead of a 8% 3 way split of my wage, i was forced to pay 15% to 1 and 8% each to the other 2,
so basically, i had to grass myself up to the csa to get them equal.... crazy!
even then, they cocked up the direct debits and i ended up paying her private in the end, through a bank transfer mind so ive got proof if ever needed0 -
ive been told that he will get hsi money back, if thats not the case then i am going to flip out!0

If the CSA DNA test comes back showing he is not the biological parent and he has not adopted the child then a refund will be paid. The CSA can try to get the money back from the PWC but this does effect the refund to the OP OH which is paid from CSA funds.
Of course how long it takes is a different question.0
