Newbie.go easy on me...Conditional Sale agreement suggestions please.....HELP!!!
Options
Hi, can anyone help with any suggestion for exiting a conditional sale agreement?
I found a car on the internet, made enquiries, was declined credit from a prime source, and then proposed to a subprime lender by the dealer. During discussions I expressed to the dealer that I may be in a position to put the deposit up to £1210.00 as I have negative equity on my trade in car which was scaring off lenders. The dealer requested loads of info (bills, payslips, driver licence) which I duly faxed. I was then asked to go to my local dealer (not the site where I am buying the car which I have not even seen yet) as my driver licence was not clear from the faxed copies. At the same time I was asked to sign a for headed pre contact information. I signed without question.
A couple of days later I was called by the company financing the vehicle, asked questions relating to the purchase price, where the agreement was signed etc. I still had no idea I had been accepted for the finance.
I was then asked by the dealer to provide 2 forms of signature which I did by email.
Next thing the dealer is arranging a date for me to 1) collect my car, 2) pay the £1210 deposit.... The contract I signed makes no mention of the £1000 only a cash deposit of £210, and the trade-in value of my old car.
I haven't yet collected the car, and have instead written to both parties explaining I would not be able to afford the £1000 on top of the monthly payments shown on the credit agreement.
I have 2 arguments, 1. the deposit should in my opinion be shown on the agremeent, I have not even been shown this on a so called order form from the dealer (the dealer & lender say it was a private deal between myself & the garage and does not constitute part of the deal) 2. the lender cannot have complied with responsible lending practices as they didn't ask for details of my current expenditure....had they it would be apparent to them that I cannot realistically afford the repayments.
Does anyone know of any clauses which might release me from this contract?

As you did not sign on office premises you should have a cooling off period.
Make sure you cancel officially now - best by next day guaranteed delivery letter.0 -
They say that as I signed on the premises which is part of the group to which the dealer belongs it renders the agreement uncancellable.0

Then first thing tomorrow ring CAB for advice.0
