Benefit/Mortgage advice needed!!!!

I am hoping that someone can help me, I am in a voilent relationship and having to move with my child out of the area. I have a house with a mortgage and although my partner lives with me (at the mo), his name is not on the mortgage. I need to move asap and the benefit office have advised they will help me with rent for a period of time whilst my house is on the market . I do forsee issues with my partner "allowing" a house sale to go through as he has no where else to go and I am concerned that by the end of the alloted time, I will be unable to gain assistance from the benefit office as they will view me as having capital available. I am currently unable to work due to health reasons so this is not helping my situation either. Any advice would be appreciated.

I would recommend you give Women's Aid a call- if you want to pm me your postcode I will happily put you in touch with your local group and the relevant (free) legal helplines. I work for Women's Aid and their knowledge of the help available to you and your child is second to none- they will also be able to advise you of all of your options- including occupation orders, non molestation orders and contact with your child.
If you want any information immediately without making the phone calls let me know- I'm at work today and will dig out what I can for you.

.... his name is not on the mortgage.
Is his name on the deeds? You can check this online via land registry if for some reason you don't know. Generally mortgages are taken in joint names if the house is held in joint names.
The reason I ask is that if his name is not on the deeds then he has no rights to the house, it is yours and you are perfectly within your rights to get rid of him and change the locks.
But only you will know what his reaction will be and obviously your safety is paramount.0
