Mortgage Advice desperately needed

I am hoping that someone can help me, I am in a voilent relationship and having to move with my child out of the area. I have a house with a mortgage and although my partner lives with me (at the mo), his name is not on the mortgage. I need to move asap and the benefit office have advised they will help me with rent for a period of time whilst my house is on the market . I do forsee issues with my partner "allowing" a house sale to go through as he has no where else to go and I am concerned that by the end of the alloted time, I will be unable to gain assistance from the benefit office as they will view me as having capital available. I am currently unable to work due to health reasons so this is not helping my situation either. Any advice would be appreciated.

God I feel sorry for you.
Your partner has no decision over whether or not you can sell the house so long as he's lived in the house for less than 2 years.
If he's lived there more than 2 years then he has certain rights and you need to speak to a solicitor.I am a Mortgage Consultant and don't like to be told what I can and can't put in a signature so long as it's legal and truthful.0 -
Did he ever sign a deed of consent?
Also I feel for you and I hope you get this sorted asap, for the sake of you and your little one!

Ian, I like your style!!!! Nothing signed, nothing in writing. Although he cant "legally" stop the house being sold, I am confident that he may delay and hinder it being sold which I cant afford to happen as I will have only a bit of support initially from the benefit office. I was wondering if I can sign the house over to my sister and get him out that way as she can move in. NOt really bothered about the money, just need to get out of the area asap.0

Hi - Surely if the house is not sold, the benefit office would be able to help you more, especially if you are on a low income\not working??
Would any family offer financial assistance until the sale went through?
Sorry, but I really don't have much mortgage advice to offer, but really wanted to say that the most important thing is that you get away, if not for your own sake than that of your child. Other stuff like mortgages can be sorted out when you're away - through solicitors or whatever, but don't stay a moment longer than necessary with this "partner".

It may be worth asking on the benefits board with regards to continuance of paid benefits etc.

Your local refuge should be your first port of call. They will establish if the has any legal right to be there and if not they will help you arrange for the police to be there while he gets your stuff together and you change the locks.

Although running away is one option it isn't always the best way. If you leave him in the house you run the risk of having no house or finding it impossible to sell.
Have you had a free half an hour with a solicitor regards injunction him and getting him removed?
