Are you saying that you didn't receive a sheet of paper back from the DVLA with the vehicles details and your name on it? It is refered to as the logbook but isn't actually a book, just a sheet of paper.
If you haven't received it, you will need to apply for it otherwise you'll find it very difficult to sell the vehicle. WRT to jeannieblue's post, no not necessarily. More likely that the documents hadn't been sent to the DVLA, the NIP went to the garage, they sat on it for a while, then dug out their sales ledger and found out they'd sold it to tonyinessex, sat on it for a bit more, then when the reminder came through, they filled the bit in that says the driver was tonyinessex. That went back to plod, sat in the intray for a bit and then eventually on to tony.
What bargepole has said/written is correct, the 14 days doesn't count if they've had to do a chase but if you follow up as he has said, and play out the game, then your home free after the six months. They do occassionally even send it to court, as they'll try any trick on to scare you in to paying. If that happens then send in your written defence back to plod and the court saying that it is outside the six months time limit and therefore not valid. End of story.0 -
They have to send the NIP to the Registered Keeper within 14 days of the offence. But if the change of ownership hadn't gone through the system at that time, you can't use that defence.
Now that you've got the NIP, you have 28 days to send back the form with your details, confirming that you were driving. If you wait until day 26 of the 28, that will take you into June. Then, after they've received it and processed it, they should send you a Conditional Offer of a Fixed Penalty, which you have a further 28 days to accept. If you do nothing (don't phone them, don't write to them), it will be the end of July before that expires.
This should take it past the 6 months from the offence date, which means they will be past the time limit for laying information at Court for a summons. They may send you another "final opportunity" to pay the fixed penalty after that, but just ignore it, they're bluffing.
