I actually agree with Conor on this, the car passed an MOT they would have just simply passed it for what was wrong on the fail sheet for a dodgy MOT.
They have offered to repair it.
Yet that is not enough and because the OP now wants rid of the car he is seaking legal action against the dealer.
IMO the car was roadworthy when it left the dealership, however, it has became unroadworthy since then (when the bolt snapped, fell out, etc) and has now needed a repair which is what the original seller is offering.
The selling garage sound to me like a decent place, offering to repair the car without fuss, but that is not enough for the OP who wants rid of the car and doesn't himself want to pocket the loss.0 -
Sorry Keith, I just can't agree with you on that one. The bolt will just not fail like that, it has to be do to being incorrectly refitted by the seller/mot garage which is why the OP has every right ot be miffed.
They should have fitted new bolts and re torqued them correctly. They would then not fail. Sounds like a lot of expence for the sack of a couple of 15p bolts

Here is an update to this story if anyone's interested. It may be of interest to any of you where anything similar happens and hopefully give you a little power to your elbow and encouragement to pursue the course of action you believe right against a Garage.
The Garage Responded in time to my request with this letter:
The day after, I received a call from the garage informing me that their legal advice had advised them to refund me my money in line with my request. They also went on to profusely apologise for what had happened, that is shouldn't have happened, and apologised for any distress it had caused me or my family.
Yesterday this cheque arrived:
I am very happy with this outcome and am currently searching for a new car, which I will pay for a full, independent health check up on before I part with any money. Thanks for your support, I appreciate it!0 -

You will see if you hang round this forum that there are some very different characters around here, (that is putting it very politely,;) ). You can almost pre-quess who will answer each question and in which manner. Some are polite, some not so polite, some right or some downright wrong. You can perm any combination out of that too.
What you are guaranteed is a mix of views and a bit of infighting toboot.
