Hit by uninsured driver

I got a new lease car at the begining of this year and at the begining of this month as I was turning into a car park. (wall at either side of the turning), a white van ran onto the back of me and pushed me into the wall. The car turned out to be a write off. The police attended and it was obnious that it wasnt my fault, I was taken away to hospital in an ambulance and at the scene the other driver said that he had a driving licence and insurance. However he could not produce these and he has since been charged with driving without a license and no insurance.

The problem is that the insurance company has already paid out to the leasing company and paid any extra to me.

Once the insrance company get the police report and discover that he wasnt insured can the ask for that back, and I now assume that I cant claim for injury ( had whipplash)..

Any advice would be great.

The insurance company won't be asking for anything back from you that they have already paid out.

You can still pursue the other driver for your injury claim (or claim via the MIB uninsured driver scheme).

Get a solicitor/claim handler to sort this for you.
