I wanted to by my husband a Wii for his birthday, and ordered a bundle from Gamestation, which was documented to included the following Get a Wii + Mario Kart (with Wheel) + Additional Remote + Official Wheel Wheel + 1GB Memory Card for £229.89. Unbeknown to me the Mario Kart game was not in stock so their website simply added everything else to my cart at full price, giving no warning that I was not getting the bundle that I had ordered. As the price was very similar I did not notice. On receiving the goods I complained, and have been offered a full refund, or a £20 voucher for their store. Not the £35 game though!! Apparently their website has since changed, but I really think they should offer what I had offered, I don't mind waiting for the stock to come in! Surely this is classed as false advertising. I am still trying to decide whether to return the goods or take the voucher.....Any advice anyone?

Well...I wasn't overcharged much, but I never got all the goods in the bundle. So I paid £230.96 and never got the Mario Kart game with Wheel, which retails at £34.99.0

I would complain again and say that you will take it further unless you received the goods you paid for. Dont back down. Its what they want!

They're under no obligation to supply the goods. You could even take them to small claims court but at most they'd order a full refund but since they're already offering this to you they're not actually doing anything wrong. You could keep complaining but if they're not planning to restock or it's a very long lead time you'd be better off going elsewhere anyway."She is quite the oddball. Thanks for that. I guess it is more the hassle than anything else that bugs me. They have been polite to deal with, and have at least addressed the issue. I guess I am just fustrated by the situation. I have a feeling I will just take the voucher and buy the Mario Kart game somewhere else, although when I type that it doesn't feel right so I probably won't. Sometimes I wish I could just forget about getting the best deal and just buy the product in the easiest manner, although I guess that could have the same hassle factor anyway!0

I should add that my actual prder does not list the game in it as it was never added, so I think I agree that it would not stand up as not receiving goods I paid for, but to me it was more a case of false advertising...0

It certainly is a shabby system to keep the offer "up" when one or more of the items is out of stock. They probably have got themselves covered and I doubt even Trading Standards will necessarily technically find anything at fault. I think it's one of those cases where your most vocal and powerful option is to demonstrate your displeasure with your feet and go elsewhere (taking refund). Their loss remember.
