can i take them back?

This question doesnt strictly fit in this category but dont know where else to post it. Last week i bought a pair of trainers for my holidays, put them on in the house and they felt uncomfortables as they have like elastic lases zig zagged accross the top of the shoe, anyway thought id better wear them around the house to break them in and hopefully the elastic would give, problem is the elastic hasnt given and i had to take them off cos the elastic was diggin in me feet and had left deep marks on my foot,( i dont even have fat feet infact they are quite slim) Took them back to shop yesterday and explained to the girl and she said they couldnt take them back as id worn them and therefore they couldnt sell them on. Im fuming i dont want to be left with trainers i cant wear, surely they are selling them unfit for purpose, can anyone tell me what my rights of returning them are. Please post any answers asap as i want to returm them today before my holiday. Thanks

    Find something small thats wrong witht them. Loose bit of stitching etc. If you return them as faulty they have no choice but to take them back.

    The problem is they are NOT unfit for purpose. There is nothing wrong with them, they just are not right for you. That is not the shop's problem, and they are quite within their rights to refuse to take them back.

    If you've been wearing them around the house for a week, then they are well and truely used, imo.

    If you do as the above poster suggests, you might be remembered from when you took them in the first time and they will know you are lying.

    Sorry, but I don't think you have any comeback on this one now.

    Perhaps if you'd taken them back straightaway, you would have got an exchange/refund if the shop was obliging.

    Were they expensive? I agree with alisojo, that if you have worn them that much, even though it was not outdoors they will still look worn and therefore they will not take them back. If you can find a fault and someone else is on the till, then,as I said before,try and return them as faulty. If it is a small shop, like alisojo said, they may well remember you, especially if you were unhappy that they wouldn't take them back the first time. If this is the case then the only thing I could suggest is to try and sell on eBay to recoup some of the money.

    i have not been wearing them for a week i had them on in the house for about 10 mins before they left marks on me feet, i have been unable to take them back as i just cant get to the shop during the week cos dont finish work untill after it closes. They traineres still have the stickers on the bottom and everything, surely they are unfit for purpose?

    Sorry, they are definately NOT unfit for purpose. There's nothing wrong with them.

    If as you say you only had them on for 10 minutes then they would still be as new. Did you make this clear to the shop?

    Consider phoning the shop and ask to speak to the manager. Explain what you have just posted above and see if he/she will be more helpful.

    Technically they are within their rights though. Most shops will exchange and in some cases refund, but there is no obligation for them to do so if there is nothing wrong with the item.

    When you took them back the first time - did you say that you had been wearing them around the house? Are you talking about a national chain of shoe shops or a small independent one? Are the shoes a well-known brand?
    If you said that you had been wearing them at all, then they would not take them back. You could try phoning the manager of the store (number and name should be on receipt) and explain the situation again - they may have misunderstood the first time and thought, like us that you had been wearing them for a week. If you still have no luck, try phoning the manufacturer to log your complaint. You may still not get a refund as the trainers do the job they were meant for i.e. they are fit for purpose, they just do not suit your foot. Sorry not to be able to help more than that.
