Bank saying not recieved acceptance of settlement letter, now expired

Hi,

I received a settlement offer last year. I sent in the acceptance of the offer just before my 2 month period was going to expire (September 2007). I made sure to retain proof of postage.

I've been abroad since then and have not gotten any settlement from the bank. When I called them they said they never received my letter and now my offer had expired pending resolution of the test case. They also said even though I had proof of postage there was nothing I could do.

My question is can I do anything to get this money before the test case resolves?
