B&S have refused my offer of payment and have said they are proceeding with the sale of property that is not in my name but belongs to my family. National Debt Agency has advised me to ignore the Bailif and force the council to accept my payments by going to the council and paying them £12 per month.Furthermore B&S have said they do not care who is advising me or what my rights are and that they are going to instruct their bailif to be more forceful..........0

I think there are THREE things on your agenda for today.
1. Stop panicing and become devoid of emotion were ct and BS are concerened.
2. Do as Herbie says - write the letter send it to BS (special delivery) and e-mail it.
3. Visit your council - give them a copy of your letter to BS ask them to take it back if not ask for their complaints procedureJune 2005 = 48K of Debt
Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

Ohhhhhh that clip was very scary. I'm due visit from Rossendales with the next 5 days and that doesn't make me feel good at all.
My situation is that we had an agreement to pay a liability order from 2003 and because one payment didn't reach them in March this year, some Council person decided it would be nice to completely screw up our lives by putting the debt out to Rossendales.
We've had the first notifcation of visit and we've been notified that unless we pay within five days the will be turning up again to sieze goods. I've read other threads and they all say not to let them in under any circumstances and definately not to sign anything. DO be polite to them however, so they have no excuses or cause to make a complaint about you.
The advice that herbie21 gives is very sound.
I'm still trying to get the Council to acknowledge that we have an agreement and that it should be reinstated, I'm going to try my local MP to see if they can give me any good advice - will let you know what they say.0 -

Thanks , i am in hell, my family has asked me to move out because of the disrepute i am bringing to the home and they do not believe B&S can be stopped. I am trying to distance myself emotionally, though panic and fear has gripped the home.I have written to B&S & sent it special delivery today.I have also written to my council but i guess i need to go and see the guy who handed over the debt and beg him to take it back.0 -

Dear Sir
We acknowledge reciept of your letters, the contents which have been duly noted.
We can confirm that we are not willing to put a payment agreement on your account.
We are unable to accept your offer of £12 per month, and at this time we are mobilising our full armnoury of resources including our bailiff and instructed them to attend to your address and seize goods by any form of recourse for sale at public auction in order to discharge this debt.
We hope this clarifies our position in this matter.

If the Police are in attendance, during avisit/attempted visit by a bailiff, then please do not think that the role of the Police is to assist the Bailiff in any way. The role of the police is to ensure that the Law is not broken, either by you or by the Bailiffs.
As for offering advice, it is, unfortunately, very evident that the Police are NOT, generally, clued up on the rights of the individual or, indeed, the powers, and limits to those powers, of Bailiffs.
Personally, I would do as advised - go to the Council and make the £12 payment - I doubt very much that they will refuse.
Keep ALL contact with B&S in writing only. Make sure that you keep a copy of the disgusting letter that they sent to you, as this is, in my opinion, proof of their disregard for the Charter to which they should abide, and may be needed as evidence.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
