Bristow & Sutor

I owe the above company money. I have given them a statement that shows i have no money and i am trying to pay off other debts. They have ignored my letters and sent someone to reposess property , of which i own none. They have written to me and listed a family member's car which is parked in the driveway and is not in my name.i have made an offer to pay them £10 per month.

How do i handle this?:confused:

    Which company is the debt owed to please? I assume Bristow & Sutor is a debt collection company?

    they are collecting council arrears

    I am in the process of taking BS to court over the use of illegal tacticts and use of non certified bailiffs to collect Council Tax. Check out my thread 'had a fight with a bailiff'.

    First things first - phone National Debt Line and seek their advise. Tell them everything and follow what they say. Your not playing the same game as them so don't try and do it alone.

    Have you had a bailiff visit you, If so you need to check if he's certified (legislation says that the bailiff needs to be certified before they can collect Council Tax). These people can advice you on this:

    Her Majestys Courts Services Headquarters - Enforcement program (020 720 0516). This is on the top of 'form 4', form 4 is what you need if you want to complain about a certified bailiff.

    Check out the National debt line website there is information on there about do's and don'ts, it helps. also check out these documents:

    Department of Constitutional Affires
    National Standards for Enforcement Agents
    May 2002

    and

    Office of Fair Trading
    Debt Collection Guidance
    Final guidance on unfair business practices
    July 2003 (updated December 2006)

    June 2005 = 48K of Debt:cry:
    Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Happy so far tomorrows another day:confused:

    Thank you I will do so asap, the bailif's are quite scary looking blokes , half the time their breath stinks of whiskey and they drive these dodgy vans, may sound funny but seriously this is what they look like.

    Just read your horrific story and have pm'd herbie to see if i can get further advice , i have also contacted the bodies you mentioned above. I have not refused to pay which is what i do not understand and the council have said they can not take the debt back into their hands from b&s......... haaaaaaaa

    Have you contacted NDL, If you are not the registered keeper of the car then you need to write to BS and tell them. Also if the car is disproportionate in value to the arrears mention this aswell (remember the sale will be at auction) They cannot take a £7000 car for a £100 debt, but they will try.

    Walsall council said that they would not take mine back. but they did!!! eventually.
