I shall be blunt as there is not other way of putting it - I am afraid you are wrong. I am an insurance underwriter - may I ask you to declare your relevant expertise?

If you had bothered to read the thread you would have noted that in an earlier post I did actually explain that a car could have a valid MOT but not be roadworthy, or indeed have no MOT but be roadworthy - i.e. it would pass an MOT test were it subjected to one.

Thus, at least in the eyes of insurers, a car does not automatically become unroadworthy simply because it does not hold an MOT.

On the validity of insurance (again as explained earlier in the thread) even if a vehicle is deemed unraodworthy, an insurer can only reject a claim (except if there is fraud) on grounds of breach of the roadworthiness condition if the unroadworthiness actually caused or contributed to the accident.

This is as per the FSA's ICOBS rule 8.1.2 (http://www.fsahandbook.info/FSA/html/handbook/ICOBS/8/1) and the Unfair Terms in Consumer Contracts Regulations.

So when you state that my post above is 'far from the point' you are seriously mistaken.
