I bought mp3 from a seller with 100% positive last week but so far i have not yet received it.
The seller has been silent with no communication at all.

Ok, assuming you purchased the item from the UK (items from abroad may take longer) and that "no communication at all" means they are failing to respond to your emails (as opposed to you not having attempted to contact them either), then I think I would be requesting their telephone number from eBay.
I once had a similar problem where I had paid but hadn't received the item after about 10 days and the seller failed to respond to about 3 emails. He was somewhat surprised to receive a telephone call from me at about 5.30pm one Sunday (time carefully chosen as it was likely based on my knowledge of his circumsatnces that he would be at home then). The buyer was apologetic, explained that the item had been posted the previous day, Saturday (which it transpired was true), explained he had been very busy at work, including working overseas the whole of the previous week, which explained why he hadn't responded to emails, etc.
Ok, I wasn't best pleased myself. Why did he offer the item for sale when he wasn't around to post it, why couldn't he get his wife to post it, why couldn't he access his emails abroad, etc, but I got my item and he wasn't left annoyed at having a dispute raised needlessly (which if he wasn't looking at his emails, he probably wouldn't have seen either)
Try giving the seller a call. If they fail to answer the calls, or give an inappropriate response, then I would raise the dispute."Now to trolling as a concept. .... Thanks for your advice the item is based in uk and he never mentioned how the item will be sent.
I will wait one more week and call the seller.0 -
Silly question - but have you messaged the seller? You can do a few things.
1 , message them to say that if you havent heard off them by a certain date, you will open a dispute - this might make them reply
2, open up a dispute without notice

I would wait 7 days from purchase then open a Paypal dispute (dont escalate to a claim straight away as that will eat into the number of claims you are allowed to make). See if you get a response to that and if not escalate it after another 7 days. Make it clear that although it is only 7 days from purchase you have not received any dispatch confirmations or reponses to emails.0

Any seller that cannot prove delivery will of course lose a paypal chargeback, it's all there in the terms and conditions and also on the helpful hints sticky thread on here.
However, sometimes it is useful where a seller is not responding to any emails to open a dispute and see if they respond to that. Do they sell alot of mp3 players and electronics ? If so it may be coming from Hong Kong even tho they say they are based in the UK
