Maintenance payments

Hi
My husband was in full employment 7 years ago, and agreed to pay his ex £400 per month maintenance for life, as she was retired and on a very low income.
He has now found himself in the same position - he is semi retired, has a small works pension, and £180 per month wages, but nothing else. I am retired with pensions. Our combined income would bring us into being eligible for benefits, except for the £400 which he pays to her each month. Even though it is a court order, and he never sees any of it, it is counted as income, which takes us out of the benefit eleigibility. Is there anything we can do - we are seriously thinking of bankruptcy as a way out of our debts - we can't carry on without some financial help. We are both 63.
Any ideas anyone?

Contact your local county court and ask for a 'variation of an order'. This will allow the courts to reassess the situation.The CAB can help you with this and a benefits calculation. Or contact age concern who specialise in benefits and money for over 60's0
