Smp & Wtc

Hi all

I've just come off maternity leave ( in the last financial ya ) As my wages dropped to smp times have been hard.

After informing the inland revenue my income had reduce they then said wait until u get ur P60 & then the 1st £100 of SMP for 29wks will be deductedfrom ur overall income for last yr, which means I should get a little more tax credits this yr. Is this the case? Has anybody every been through this themselves?

I'm still waiting on my P60 & don't want to get my hopes up.

  • If you had 26 weeks maternity leave you would deduct the £100 for every week, if it was the 39 weeks you would do the same - so either deduct £2600 or £3900 from the figure on your P60 when you are completing your annual renewal declaration.

    You should have your P60 by the end of May.

    1st post so please be gentle :D

    I came off my Maternity leave in May 07 and for my tax credits and working tax credits had not deducted part of the 26 weeks £100 for the 06 - 07 tax year, so am I allowed to deduct the 26 weeks £100 for this tax year as I didnt finish my maternity leave until this this (07 - 08) tax year or am I now only allowed to deduct the 5 weeks of the new tax year (£500)?

    Any info greatly appreciated!

    Thanks for your help with this one, ur right i was off 39 wks so all's i need to do is take £3900 of my P60 total. Thats great, hopefully I'll get a little extra.

    Unfortunately you can only deduct the weeks you had in the 07/08 tax year. You cant deduct all of it as that would be "fraudulent". Unfortunately you will have lost out for the 06/07 tax year. You can try to get your figures corrected for 06/07 but the likely outcome is that they would not change them as Tax Credit law will not let TCO adjust the figures unless there has been an error in their part. They can adjust figures as long as it means they pay nothing further to you as that award has now been finalised.

    Sadly I wasnt made aware of the £100 deduction at the time but ...

    "Fool me once .... etc " lol

    Next time I will claim my 39 weeks back :)
